Changes to the Terms

We reserve the right, at our discretion, to update or revise these Terms at any time. We will post such changes on this page, and any additional or revised Terms will become part of the agreement. The updated Terms will take effect immediately upon posting, unless otherwise specified. You should check this page regularly to see if a new version has been posted. If the amended Terms are not acceptable to you, your only recourse is to cease using the Application. Continued use of the Application constitutes your binding acceptance of the updated Terms.

No Medical Advice

The Application is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease or medical condition. It is designed solely as a contraction tracker and informational aid for pregnant women. It does not provide medical advice, diagnosis, or treatment, and should not be used as a substitute for professional medical advice, diagnosis, or treatment. Always consult with a qualified healthcare professional (such as a doctor, midwife, or nurse) for any health concerns or before making any decisions about your health.

We strive to provide accurate and reliable information sourced from reputable references. However, we do not guarantee the accuracy, completeness, or usefulness of any information provided. Reliance on any information provided by the Application is solely at your own risk.

This Application is not intended for use during medical emergencies. If you experience severe pain, complications, or signs of labor, seek immediate medical attention. Do not rely on the Application for emergency medical decisions.

Age Requirements

The Application is intended for individuals aged 13 years or older.

For Users in the European Union, in accordance with the General Data Protection Regulation (GDPR), you must be at least 16 years old to use the Application.

If you are between 13 and 18 years of age (or the legal age of majority in your jurisdiction), you must review these Terms with your parent or guardian to ensure both you and your parent or guardian understand and agree to them. Your parent or guardian must accept these Terms on your behalf. If you are a parent or guardian and accept these Terms on behalf of your child, you accept full responsibility for their use of the Application.

User Conduct

You agree to use the Application in a lawful, respectful, and responsible manner. You must not:

• Violate any applicable law or regulation;
• Interfere with or disrupt the operation of the Application or any networks connected to it;
• Use the Application for any fraudulent, harmful, or malicious purpose;
• Attempt to gain unauthorized access to any part of the Application, its systems, or data.

Intellectual Property Rights

All content, features, and functionality of the Application (excluding data processed solely on your device, such as your contraction data) are the property of BabyReco LLC or its licensors and are protected by applicable intellectual property laws.

You may not copy, reproduce, distribute, or exploit any part of the Application without prior written consent, except for the data you input and which is processed on your device (such as your contraction logs or summaries), which you may copy, store, or share for personal use or medical consultations.

Disclaimers and Limitation of Liability

The Application is provided to you on an "as is" and "as available" basis, without warranties of any kind, either express or implied. To the fullest extent permissible pursuant to applicable law, BabyReco LLC disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

BabyReco LLC does not warrant that the Application will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We make no warranties or representations regarding the use of the Application or the information provided therein in terms of its correctness, accuracy, reliability, or otherwise. Your use of the Application is solely at your own risk.

You acknowledge and agree that:

• If you use the Application outside a Wi-Fi area, your mobile provider’s charges may apply for data usage or roaming. You are solely responsible for any such charges. If you are not the bill payer for your device, you represent that you have obtained permission from the responsible party.
• We are not responsible for your device’s battery level or power status. If your device runs out of battery and you are unable to use the Application, we cannot be held liable.
• Some features of the Application require an active internet connection (Wi-Fi or mobile data). We are not responsible if the Application does not function fully due to lack of connectivity or data limits.
• While we strive to ensure the Application is accurate and up to date, we do not guarantee it will be free of errors or interruptions. You are responsible for ensuring that the Application functions correctly on your device.

To the fullest extent permitted by applicable law, in no event shall BabyReco LLC be liable for any direct, indirect, incidental, special, consequential, or punitive damages (including, without limitation, damages for loss of profits, data, or goodwill) arising out of or in connection with your access to, use of, or inability to use the Application, or any content or information provided through the Application, whether based on warranty, contract, tort (including negligence), or any other legal theory, even if we have been advised of the possibility of such damages.

Termination

We reserve the right to suspend or terminate your access to the Application at any time and for any reason, including if you violate these Terms. Upon termination, your right to use the Application will immediately cease.

Data Collection and Privacy

Your privacy is very important to us. We handle information as described in our Privacy Policy.

Some data is processed and stored only on your device and is never transmitted to our servers or shared with third parties.

We also collect certain pseudonymized data to understand how the Application is used and improve your experience. This may include technical details, usage patterns, and general pregnancy-related metadata (e.g., pregnancy week or whether this is your first pregnancy).

You are responsible for maintaining the security of your device and access to the Application. We strongly discourage jailbreaking or rooting your device, as this may compromise security and result in the Application not functioning properly or at all.

Third-Party Services

The Application may use third-party services (e.g., analytics, crash reporting, subscriptions). These services are governed by their own terms and privacy policies regarding data collection and processing. Please refer to our Privacy Policy for details.

Apple App Store Terms

You acknowledge and agree that these Terms are concluded between you and BabyReco LLC only, and not with Apple Inc. ("Apple"). BabyReco LLC, not Apple, is solely responsible for the Application and the content thereof. You agree to comply with all applicable third-party terms of agreement when using the Application (e.g., your wireless data service agreement). You acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Application. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Application.

Apple is not responsible for addressing any claims by you or any third party relating to the Application or your possession and/or use of the Application, including, but not limited to: (i) product liability claims; (ii) any claim that the Application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection or similar legislation.

Apple is not responsible for the investigation, defense, settlement, and discharge of any third-party claim that your possession and use of the Application infringe that third party’s intellectual property rights.

You agree to comply with all applicable terms of agreement when using the Application. Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms, and that, upon your acceptance of the terms and conditions of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.

Subscriptions and In-App Purchases

The Application offers auto-renewing subscriptions to unlock full features and content. If you choose to subscribe, you agree to the terms and conditions of purchase applicable to that specific subscription. All such purchases are handled through Apple’s App Store and are subject to their respective terms and conditions, including payment and refund policies. We do not have access to your payment information. You should review Apple's terms and conditions related to Subscriptions and In-App Purchases.

Important details regarding auto-renewing subscriptions:

• Subscription Renewal: Subscriptions automatically renew at the end of each billing period (e.g., monthly or annually) unless you cancel them at least 24 hours before the end of the current period. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period at the rate selected for your subscription.
• Cancellation: You can manage and cancel your subscription at any time by going to your device's subscription settings. To do this, on your iPhone or iPad, go to Settings > [your name] > Subscriptions.
• Effect of Cancellation: Cancellation takes effect at the end of the current billing period. You will retain access to the subscription features until that time. Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription.
• Price Changes: We may change the price of your subscription after giving you reasonable notice. If you do not agree to the new price, you may cancel your subscription prior to the new price taking effect.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law principles. Any disputes arising from or related to these Terms shall be subject to the exclusive jurisdiction of the courts located in Wyoming.
